How exactly should they assess damages in the copyright infringement case involving Bratz dolls? The Riverside jury has already found that the Bratz creator was still working at Mattel when he sent off drawings to another toymaker, MGA Entertainment. Mattel says it's owed close to $2 billion for the breach, but in response to a jury question late last week, U.S. District Judge Stephen Larson said that damages could be limited to the first generation of Bratz dolls. That might result in a much lower number than the $2 billion (deliberations continue on Tuesday). "What are the options regarding a starting point, if any, with respect to damages?" the jury asked in a note. "In reference to question 1 (on the 9-page verdict form), we are struggling at this point." There is a lot at stake here – Bratz revenues are estimated to run $1 billion a year, while Barbie sales keep falling. Of course, any decision is certain to be appealed. (LABJ, Reuters)
